Bitcoin - the legal framework and practical aspects of its use in payment transaction

in english The purpose of this theses is to analyse the Bitcoin electronic peer-to-peer payment system, from the view of the legal, regulatory and also purely practical issues surrounding its use as a modern means of payment processing. The reason for choosing this topic is that I find the subject to be very interesting and possibly promising for the future of payments. Also, as the use of Bitcoin payment system spreads across the global population, we can see many of legal questions arising: Is the use of Bitcoin network legal? How is it regulated under existing legal system? Can it be subsumed under any existing legal categories? What are the risks of its misuse for criminal activities? Should new legal rules be enacted to regulate its use, and if so, what should these rules be like? My goal in this paper is to find these relevant questions, elaborate on them and provide as many answers as will be possible. We have to bear in mind the fact, that the technology, underlying the Bitcoin payment systém is very new and many ways path-breaking. As usual, the legal theory lags behing technology here, so many questions still have to be settled before we can give any straight answers. The financial and legal aspects of alternative payment systems from the anti-money laundering prespective Abstract The aim of this thesis is to provide a general overview of the current state of alternative payment systems with regard to their inclusion in the financial market, their properties and potentials for wider use, and to evaluate their possibilities to more effectively combat money laundering, terrorist financing and the proliferation of weapons of mass destruction. In the first chapter, the thesis explains the broader context with regard to financial systems, especially within the money market systems focusing on retail, while providing a deeper explanation of the context of European law and Czech law. The second chapter is focused on closer analysis of alternative payment systems with regard to their use. Alternative payment systems are divided into two basic categories for centralized alternative payment systems and decentralized alternative payment systems. Regulation of alternative payment systems operated through FinTech platforms Abstract (ENG) The aim of this master thesis is to focus on payment systems, define alternative payment systems, comprehensively summarize the effective regulation in the Czech Republic and then critically evaluate the level of this regulation regarding future technological developments in this area. In the introductory parts of this master thesis the author focuses on the general definition of payment systems, the possibilities of their theoretical division. Different types are afterwards compared to each other and some pros and cons are listed. Subsequently, the author focused on practice-based payment systems in the Czech Republic, namely CERTIS and ABO, and then ones functioning at the European Union level, especially TARGET 2, EURO1, SEPA 1, SEPA 2 and RT1. The next section describes the payment system with settlement finality as an example of a traditional payment system and then discusses three potential alternatives that could be considered as alternative payment systems. Payments and position of SEPA payments in payment systems

The masters thesis Payments and position of SEPA payments in payment systems deals with the transition of the national payment system to SEPA payment instruments in the Czech Republic, which is coming into force this year. Banks will have to fulfil requirement of interoperability and will have to be able to proceed payments in XML form. The theoretical part defines payments by the payment form and territorial payments in the first chapter. In the 2nd chapter, the legal framework with focus on new legislation affecting the completion and implementation of the SEPA requirements is described. The following two chapters are devoted to payment systems in the Czech Republic, European Union and telecommunication network SWIFT. The 5th chapter discusses about the SEPA project, with the main emphasis on the definition of SEPA instruments. The practical part is dedicated to analysis of foreign payment fees in selected banks with a focus on individuals.

Nowadays most payments for goods and services are realised by means of cashless payments. The thesis defines several sections, or partial objectives. The main objective is the characteristic features of payment systems used in the Czech Republic , followed by the analysis of the contemporary payment transactions in the Czech Republic ? organisation. The partial objectives describing payment transactions in the European Union, evaluating payment instruments in practice emphasising topical trends in this area.

The goal of the thesis is to analyze chosen electronic payment systems. The thesis is divided into two parts -- theoretical and practical. Theoretical part is dedicated to cover types of electronic payment system. Also is devoted to the issues of certain legal aspects that are common to all payment systems; defines the necessary concepts and business entities commonly encountered in the payment processing environment. Practical part focuses on the evaluation of usability, safety and usefulness for merchants mainly working with credit cards and particularly with alternative payment system like PayPal, iDEAL, Sofortbanking and Webmoney. Consider the advantages and disadvantages of certain payment systems. Describes the practical applicability of PCI DSS and 3-D Secure protocol.
